Beta Testing Agreement

By participating in CareEcho's beta testing program, you acknowledge that the Service is in development and may contain bugs, errors, or incomplete features.

What CareEcho Provides

• Personalized health insights and recommendations
• Conversation history and continuity features
• Educational health information and resources

Service Limitations

• CareEcho is not a medical device or diagnostic tool
• The Service does not provide medical advice or treatment
• Information provided is for educational purposes only
• The Service should not replace professional medical care

Beta User Responsibilities

• Provide constructive feedback about your experience
• Report bugs, errors, and technical issues promptly
• Do not share screenshots, recordings, or detailed features publicly
• Maintain confidentiality about beta features and capabilities
• Use the Service for testing purposes only, not critical health decisions

Beta Limitations

• No warranty or guarantee of service availability
• Features may be removed or changed without notice
• Data may be lost during updates or maintenance
• Performance may be slower than final release
• Customer support may be limited

Confidentiality

You agree to keep confidential all non-public information about CareEcho's features, capabilities, and performance. This includes not sharing screenshots, recordings, or detailed descriptions without written consent from MG Consultant LLC.

Important Medical Disclaimers

• CareEcho is not FDA-approved as a medical device
• Information provided is for educational purposes only
• Do not use CareEcho for medical emergencies
• Always seek professional medical advice for health concerns
• Do not delay or avoid medical treatment based on CareEcho interactions

Emergency Situations

If you are experiencing a medical emergency, immediately contact your local emergency services (911 in the US) or go to the nearest emergency room. Do not rely on CareEcho for emergency medical assistance.

Professional Medical Relationship

Use of CareEcho does not create a doctor-patient relationship or any professional medical relationship. CareEcho is not a substitute for professional medical care, diagnosis, or treatment.

Account Creation

• You must provide accurate and complete information
• You are responsible for maintaining account security
• You must be at least 18 years old to create an account
• One account per person is permitted

Account Security

• Keep your password secure and confidential
• Notify us immediately of any unauthorized access
• You are responsible for all activities under your account
• Do not share your account credentials with others

Account Termination

You may delete your account at any time. We may suspend or terminate accounts that violate these Terms or for any reason during the beta testing phase.

Prohibited Uses

• Use the Service for illegal activities or purposes
• Attempt to reverse engineer or hack the Service
• Share or distribute confidential beta information
• Use the Service to harm others or spread misinformation
• Attempt to overwhelm or disrupt the Service
• Use automated tools to access the Service
• Impersonate others or provide false information
• Use the Service for commercial purposes without permission

Content Guidelines

When interacting with CareEcho, you agree not to share content that is illegal, harmful, threatening, abusive, defamatory, or violates the rights of others.

Our Rights

• CareEcho and all related technology are owned by MG Consultant LLC
• All trademarks, logos, and brand names are our property
• The Service is protected by copyright and other intellectual property laws
• You may not copy, modify, or distribute our intellectual property

Your Rights

• You retain ownership of your personal information and conversations
• You grant us a license to use your data to provide and improve the Service
• You may request deletion of your data at any time
• We do not claim ownership of your personal health information

Feedback and Suggestions

Any feedback, suggestions, or ideas you provide about CareEcho may be used by us without compensation or attribution to improve the Service.

• We do not warrant that the Service will be uninterrupted or error-free
• We do not guarantee the accuracy of information provided
• We do not warrant that the Service will meet your specific needs
• We disclaim all warranties, express or implied, including merchantability

Beta Testing Disclaimers

• Beta software may contain bugs, errors, or incomplete features
• Performance may be unpredictable or unstable
• Data loss or corruption may occur during testing

Third-Party Services

CareEcho may integrate with third-party services. We are not responsible for the availability, accuracy, or reliability of third-party services.

Damages Limitation

• Our total liability shall not exceed $100 or the amount you paid us
• We are not liable for lost profits, data, or business opportunities
• We are not liable for damages caused by third-party services
• We are not liable for damages from unauthorized access to your account

Health-Related Limitations

• We are not liable for health decisions made based on CareEcho interactions
• We are not liable for delays in seeking medical treatment
• We are not liable for misinterpretation of health information
• We are not liable for any adverse health outcomes

Beta Testing Limitations

During beta testing, our liability is further limited due to the experimental nature of the Service. You participate in beta testing at your own risk.

Your Indemnification Obligations

You agree to indemnify, defend, and hold harmless MG Consultant LLC from any claims, damages, or expenses arising from:

• Your use or misuse of CareEcho
• Your violation of these Terms
• Your violation of any law or regulation
• Your infringement of third-party rights
• Any content you provide or share through the Service

Defense and Settlement

We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with our defense.

Termination by You

• You may terminate your account at any time
• You can delete your account through your profile settings
• Termination does not relieve you of obligations incurred before termination

Termination by Us

• We may suspend or terminate your account for Terms violations
• We may terminate accounts during beta testing for any reason
• We may discontinue the Service with reasonable notice
• We may terminate immediately for serious violations

Effect of Termination

• Your access to the Service will be immediately revoked
• Your data may be deleted according to our retention policies
• Provisions that should survive termination will remain in effect
• You may request data export before termination

Beta Testing Termination

The beta testing program may be terminated at any time. Participants will be notified of termination and may be invited to continue with the public release.

Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction where MG Consultant LLC is incorporated, without regard to conflict of law principles.

Dispute Resolution

• We encourage resolving disputes through direct communication first

• Disputes may be subject to binding arbitration
• Class action lawsuits are waived to the extent permitted by law

Jurisdiction

Any legal proceedings must be brought in the courts of competent jurisdiction where MG Consultant LLC is located.
